DMCA Copyright Infringement Policy
Chobani LLC ("Chobani") respects the intellectual property rights of others and expects its users to do the same. This policy outlines the procedures for addressing allegations of copyright infringement concerning content hosted on Chobani's websites and online platforms, including any content that may pertain to the "Chobani Yogurt Lawsuit" or related discussions.
It is Chobani's policy to expeditiously respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable intellectual property laws.
Filing a DMCA Notice of Copyright Infringement
If you believe that material residing on Chobani's platform infringes a copyright, please send a written notification of claimed infringement to Chobani's Designated Copyright Agent with the following information:
- Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: Provide a description of the material that you claim is infringing and sufficient information to permit Chobani to locate the material on its website or platform (e.g., URL, specific page, filename).
- Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receipt of a valid DMCA notice, Chobani will remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted the material.
Filing a DMCA Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a written counter-notification to Chobani's Designated Copyright Agent. Your counter-notification must include substantially the following:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
- A statement of good faith belief: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Subscriber's name, address, and telephone number: Your name, address, and telephone number.
- Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Chobani may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Physical or electronic signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, Chobani may restore the removed material in 10-14 business days unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity.
